I noticed today when I put the top down the driver side takes a little effort to get the hold down to catch & once caught is held down snuggly while the passenger side catches w/out any extra effort & sits up from the body a couple of inches higher. any ideas??

Sounds like your top struts are wonky.
They are behind the rear quarter window frame. They attach to the top and to the bottom with a c-clip.
If you remove the bottom clip ( can get to it from the trunk) and remove it off the pivot shaft. Open and close the top if there is no difference than before it is the strut that is bad.
Then try the other side. Better or worse?
New struts are available.

here are some pics I don't think it's a strut
when I put the top down the pass. side latches automatically I have to push down to latch the drivers side in the pics both side are latched any ideas?

First.
Oil all your pivot points.
Second.
Take your struts off of the mounts on the bottom and see how it closes because it looks like the one is binding.
Do not try to over force it, you can bend the hell outta the frame with little effort.
